However, Jolie’s claims were not upheld at the time. According to court records, Jolie did not show evidence that would give legal grounds to disqualify the judge. Jolie’s attorneys appealed and last Friday an appeals court decided to disqualify John W. Ouderkirk, agreeing with Jolie’s suggestion that he had not sufficiently disclosed his business relationship with Pitt’s attorneys.

“Violation of Judge Ouderkirk’s ethics, when considered in conjunction with disclosures relating to his recent professional relationship with Pitt’s attorney, may cause an objective person, aware of all the facts, to have reasonable doubts about the judge’s ability to be impartial. Pitt’s attorney, Theodore Boutrous, said claiming the judge’s disqualification was Jolie’s tactic to stem Ouderkirk’s recent preliminary child custody decision. The decision was favorable for Brad Pitt, as it granted custody rights to both parents, half and half.
