Certificate checks

Employees, as well as employers themselves, may enter the workplace only if they have a document confirming their 3G status with them. According to the Ministry of Labor, the 3G proof requirement “also applies to workers who cannot be vaccinated for medical reasons”. The employer is responsible for checking the certificates. However, he may also delegate this task to “relevant employees or third parties” in accordance with data protection law. The focus of the control should be the validity of the test. Because people who have not been vaccinated or recovered must show negative test results every day. Vaccinated or convalescent persons may be exempted from daily checks if the employer has once verified and documented the validity of their certificates.

What may an employer require?

According to a spokesman for the Federal Ministry of Labor, enterprises cannot directly inquire about the vaccination status of their employees, even with the new 3G regulation. However, employers must ask for proof that one of the 3G conditions has been met. Anyone who does not wish to disclose their vaccination status must produce a negative test result.

In the case of vaccinated and convalescents, it is enough to document their status once. However, for the latter, the end date must be provided. According to the Ministry of Labor, employees with a valid vaccination or recovery certificate are later essentially exempt from daily checks.

In addition, the data must be deleted at the latest six months after collection. And employers must ensure that they do not end up with unauthorized persons or other co-workers.

Home testing is not enough

A rapid antigen test is required from unvaccinated persons, which was performed no earlier than 24 hours ago at public collection points or at doctor’s offices. It is also possible to carry out a home cassette test at the workplace under supervision or by authorized persons. The PCR test result must not be older than 48 hours.

Who pays for the tests?

The costs of the tests are borne by the employees. Employers are only required to check 3G evidence prior to entering the workplace and document these checks. The provisions of the Infection Protection Act do not impose any additional obligations on the employer. However, in the case of office work, the employer must allow remote work, unless it is not possible for important economic reasons.

High penalties

For violation of the obligation to check the 3G rule in the workplace, the Infection Protection Act provides for a fine of up to 25,000 zlotys. euro. The Ministry of Labor also warns that those who are unable or unwilling to provide evidence of 3G and therefore do not work, “generally have to fear the consequences of dismissal.” have the right to remuneration, “the ministry says.
