From January 1, a new method of billing for fuel in Poland. The ministry provided further details

At the beginning of November, we informed about a new method of billing for fuel throughout Poland. The new regulations will enter into force on January 1, 2022, and today the Ministry announced further details about the National System of e-Invoices (KSeF). The invoice template has been made available on ePUAP, and drivers will be able to get a refund for fuel much faster.

A new way of billing for fuel


In November, the Seym passed a bill implementing the so-called National System of e-Invoices. The new privileges will apply from January 1, 2022. The use of e-Invoices will not be mandatory initially, but we still encourage drivers who take fuel invoices to use it. Why?

The e-invoice for fuel will bring us a number of benefits. If we decide on this type of solution, we will receive a VAT refund much faster, not after 60, but already after 40 days. Depending on the size of the fleet and the amount of fuel refueled, this can be an important change for many entrepreneurs.

But that’s not all – we will not be required to issue duplicate invoices, and the e-invoice issued once will remain in the database and will not be damaged or lost. This solution is already used in three other European Union countries. Italy was the first to introduce e-invoice in 2017, then Spain, and finally Portugal. Poland will therefore be the fourth country to introduce such a facility for its citizens.


Deputy Minister of Finance, Jan Sarnowski: – By providing entrepreneurs with an e-invoice, we join the group of European leaders of modern e-administration services. Poland will be the fourth EU country to implement it. Italy did it in 2017, Spain one year later, and Portugal in 2019. E-invoicing is not only a great help for companies, but also the most technologically advanced way to combat VAT fraud. Thanks to big data analyzes, the pace of detecting tax criminals has shortened from several years to several months. After the implementation of e-invoice, it will be counted not in months, but in weeks. This will further reduce the VAT Gap to around 5%, such as in France.

At the beginning, e-Invoice is voluntary

Although e-Invoice will not be mandatory initially, it will change after a year. From January 1, 2023, every driver taking an FV for fuel or other goods or services will have to choose a new, electronic invoice.

On December 3, 2021, the so-called logical structure of e-Invoices (FA_VAT). The published formula takes into account the comments submitted during the tests to the draft structure of the structure.

The Ministry of Infrastructure is working on adjusting the test environment for sending files according to the updated template. “We plan to release the updated test environment on December 13, 2021. We will inform about it in a separate announcement – we read on the website of the Ministry of Finance.

Polish entrepreneurs will use e-Invoices voluntarily from January 2022. It will be one of the acceptable forms of documenting sales – next to paper invoices and electronic invoices, which are already in use in economic transactions. “We plan to make entrepreneurs use e-Invoices obligatorily in 2023. ” – we read.
