Napoli will no longer be able to use the effigy of Maradona on their shirts. This was decided by the judge Paolo Andrea Vassallo, of the second civil section of the court of Naples, who gave reason to Jorge Sebastian Baglietto, the judicial administrator who protects the interests of the 5 children heirs of the former Pibe de Oro in the dispute with the entrepreneur from Campania Stefano Ceci, legal representative of Diez Fze, a company based in Dubai.
Napoli had signed an agreement with Ceci
Napoli had used the image of the Argentine champion on the jerseys last season after the club had acquired from Ceci himself those rights resulting from an agreement signed a few months before Maradona’s death with the entrepreneur. But the heirs of number 10 and Baglietto, represented in court by the Roman lawyer Antonietta Tomassini and his colleague Federica Meglio, who also requested the seizure of the proceeds deriving from that contract for a sum of no less than 450 thousand euros, obtained the injunction for the diffusion and use of the image in any form.
A contract deemed “detrimental to financial expectations”
For the judge, the contract signed by Ceci with Napoli, amounting to just under 23 thousand euros, was “detrimental to the patrimonial expectations” that the heirs have in relation to the exploitation of the image of Maradona, “a planetary symbol of football,” recognized and recognizable all over the world, whose economic value appears to be of considerable importance, almost inestimable “.
The heirs had served Ceci a formal notice
The commercialization of Diego Armando’s image on 6 thousand jerseys yielded an almost immediate gross income of about 900 thousand euros. And the contract signed by Maradona in August 2020 with Ceci awarded the licensor 50% of the proceeds, never received by the heirs. Who, among other things, one month after the agreement between Ceci himself and Napoli on the marketing of the image of the champion as stylized and created by the architect Giuseppe Klain on the first team’s jerseys, notified a deed of warns, considering that use is improper, with the simultaneous removal of photos and images of the former Argentine idol.
150 thousand euros seized from Ceci
Not being able to intervene on the marketing of the shirts (obviously all sold) and taking into account the good faith of the Neapolitan club, the judge therefore decided to issue an injunction against Ceci in light of “his abusive behavior” and detrimental to interests of the Maradona heirs, authorizing inter alia a precautionary attachment set at 150 thousand euros.
