UOKiK imposed a fine on the owner of the car park at the pharmacy (ul. Hirszfelda), who preyed on customers

Parking lot next to the oncology hospital in Wrocław. Information on advertising banners stating that pharmacy customers can park for up to 20 minutes for free. Hook? An additional condition for free parking is included in the regulations, which cannot be read directly from the car. Did you not collect your ticket at a nearby car wash? PLN 200 fine.

The operator of the car park – Łukasz Zbróg – used practices that mislead consumers – said Tomasz Chróstny, President of the Office of Competition and Consumer Protection, in his decision.

UOKiK received complaints about the operation of the car park operated by the entrepreneur Łukasz Zbróg in Wrocław. Parking spaces are located at pl. Hirszfelda 14 in Wrocław, in the immediate vicinity of the Lower Silesian Cancer Center and located along a road. Advertising banners inform that customers of the pharmacy located in front of the car park can park for up to 20 minutes for free. There is no parking meter installed at the stop and there is no operator. Meanwhile, in the regulations, on fine print, not readable directly from the car, located away from the parking area there is an additional condition – free use is possible after collecting a ticket from a nearby car wash employee. The complaints showed that the additional fee (PLN 200) was imposed when the consumer did not meet the above-mentioned condition (which he usually did not know about) and did not collect the ticket. Since 2018, the entrepreneur regularly asks consumers to submit the above-mentioned fees.

  • “(…) I would like to mention that there is a large billboard with information that the car park is 20 minutes free for pharmacy customers, but there is no information that a parking ticket must be collected at a car wash. The lack of information on the billboard about the ticket collection deliberately misleads customers to instead of charging a parking fee, extorts and extorts high amounts with calls for payment in order to derive unjustified company’s income. “
  • “The complaint has not been accepted – the payment has been made. Our doubts, however, are raised by the marking of the car park, which clearly misleads drivers. There is a large banner on the front of the pharmacy, which shows that the parking is free for customers of the pharmacy for up to 20 minutes. In front of the entrance to the pharmacy, there is a road sign indicating a parking lot – under the letter P there is no sign that it is a paid car park. “
  • “(…) Each private car park has a person who supervises it and collects parking fees. There is nothing like that there, not to mention a parking meter. In my opinion, this is a deliberate action to extort money, the more that there are several facilities in this area with a lot of patients and a lack of parking spaces.

Operation of the car park raised doubts of the President of UOKiK, who appeared twice to Łukasz Zbróg o taking actions aimed at removing irregularities in the marking of the car park. The matter was also publicized by the media incl. “Gazeta Wrocławska” i “Fact”. Calls for a more legible marking of the space did not meet with a positive response from the entrepreneur. It did not introduce any changes – neither in the marking of the car park, nor in ensuring its proper operation.

In the years 2018-2021, consumers regularly submitted complaints to the entrepreneur in which they questioned the above-mentioned additional fee. The President of UOKiK found that some of them had been taken into account, but the entrepreneur resolved this in an unclear manner. There was a lack of fair and honest treatment of consumers who filed a complaint and were able to prove that they had purchased at a pharmacy. In such a situation, the trader should allow consumers to provide explanations and accept complaints – explains the President of UOKiK, Tomasz Chróstny.

The President of UOKiK, Tomasz Chróstny, stated that Łukasz Zbróg deliberately used unfair market practices, misled consumers and violated their collective interests. He imposed a financial penalty of over PLN 50,000. PLN and the obligation to post information about the decision in the regional press. After the decision becomes final, consumers will be able to pursue claims against Łukasz Zbróg on the basis of the Act on Unfair Market Practices, relying on the decision of the President of the Office of Competition and Consumer Protection.

I have been observing the practices of parking fraudsters for many months and my concern is especially about parking spaces at hospitals and clinics. They should be clearly marked to avoid confusion. The rotation of vehicles parking in such specific places is large, and a significant proportion of those who parked there for the first time. People come to these types of facilities with the health or health of their relatives in mind, often in a hurry, it is unethical to prey on them and set parking “traps” – says the President of UOKiK, Tomasz Chróstny.
