Shopping Sunday. When does it fall in December?

The peak shopping season is usually the pre-holiday season, when everyone goes for gifts and pre-holiday shopping. In December, the legislator provided for two exceptions to the trade ban. They fall on two weekends before Christmas Eve.

Trading Sunday is a popular term, informing that on this day, on Sundays and holidays, trade restrictions related to the entry into force of the 2018 Act on the restriction of trading on Sundays and holidays and on certain other days are not applied. From 2020, the ban will apply to almost all Sundays

Shopping Sunday – calendar

By parliamentary decision, from March 1 to December 31, 2018, trade was allowed only on the first and last Sunday of the month and on two Sundays before Christmas and one Sunday before Easter. In 2019, trading can only take place on the last Sunday of the month, as well as on two Sundays before Christmas and one Sunday before Easter.

The biggest changes regarding commercial and non-trading Sundays await customers from 2020. Then, we will be able to do shopping only on the last Sunday in January, April, June and August, two Sundays before Christmas and one Sunday before Easter.

Trading ban on Sunday 2021 – exceptions

The Sunday Trade Restriction Act, however, provides for a number of exceptions in the case of stores that can sell on these days. These are mainly shops run by entrepreneurs “on their own behalf and for their own account”. This law does not apply to gastronomy. Accordingly, restaurants and bars will be able to be open. Their functioning in shopping centers is problematic.

The exceptions to the prohibition of trade include:

  • bakeries
  • pastry shops
  • ice cream parlors
  • fuel stations
  • florists
  • shops with souvenirs and devotional items
  • newspaper stores
  • shops with public transport tickets
  • tobacco shops
  • post offices
  • shops at railway stations (in the field of direct passenger service)
  • airports
  • free zones
  • trade in means of public transport
  • trade in garrisons
  • trade in penitentiary establishments
  • trade in agri-food wholesale markets
  • establishments purchasing cereals, sugar beet, fruit, vegetables or raw milk
  • outlets selling spare parts and agricultural machinery (only in the period from June 1 to September 30).

Shopping Sunday – the genesis

The introduction of the Sunday trading ban was motivated by the applicants by the desire to allow employees to rest on the seventh day of the week and to spend it with their families. Moreover, the model was taken from German-speaking countries, where this ban has been in force for many years.

In 2014 Diet rejected a civic bill introducing a ban on working in retail outlets on Sunday. However, three years later, the bill submitted by the Legislative Initiative Committee, which included, inter alia, NSZZ “Solidarność” was adopted by the parliament.

Thus, from 2018 in Poland trading is prohibited on certain Sundays. Ultimately, it is to cover almost all Sundays in 2020.
